Terms & Conditions of Reservations

1. General

All bookings are made with ethailandvillas.com or any of its affiliates acting as agents on behalf of the owners/management of the properties featured in the ethailandvillas.com or its affiliated websites. By submitting an enquiry form it shall be taken as confirmation of acceptance of the following conditions.

2. Bookings

2.1 Provisional Confirmation of Availability and Rates

Upon receipt of a request for availability, the applicable Villa rates and the amount of deposit required will be confirmed. Bookings are on a 'first-come, first-served' basis and each villa has a minimum number of nights as well as specific conditions for Christmas, New Year, Easter or summer holidays (see each villa description for more details).

2.2 Rates

Villa rental rates quoted on ethailandvillas.com or any of its affiliated sites are on a per night basis and are a quoted in US dollars or Thai Baht, unless otherwise specifed. Rates quoted allow for maximum occupancy of the villa as shown on the web sites. Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. The cost of electricity, water, cleaning and gardening supplies, local taxes, and so on are included in the rental rates, unless otherwise specified. All villas offered by ethailandvillas.com or any of its affiliated sites are fully equipped with linen, crockery, utensils, and for some of them an initial supply. , unless otherwise specified

2.3 Not included / additional charges

Most villas are equipped with telephone lines and most villas have access to fax facilities. All call charges may have to be settled before departure.

Airport transport is provided for all villas either free of charge or at a specific charge as detailed in each villas fact sheet.

Rates do not include baggage handling, airport transfers when not provided as a service, gratuities, telephone, fax and telegram charges, car rental, food, soft drinks and/or liquor, personal items and expenses, and any excessive cleaning required upon departure (such as upholstery or rug shampooing, etc).

Linen and towels are included in all Villas. The linen are for all villas changed either every day or at the maximum every three (3) days, unless otherwise specified. If you require more frequent changes there may be extra charges. Laundry facilities will be charged on a per item basis and at minimal cost.

3. Payment

3.1 Currency

All rental rates are in US$ or THB, however, in case of payment made locally to the villa owner or management company, the Thailand regulations require that all charges are made in Thai Baht converted at the rate of exchange applied by Bank of Thailand on the day of the debit.

3.2 Initial Deposit

An initial deposit of the villa rental, which amount is variable and depends on each villa (see Rates and sales conditions for each villa), together with the completed Guest Booking Form must be received by ethailandvillas.com or any of its affiliated sites before a confirmation can be issued. No confirmation will be issued between you and the villa owner(s) or management company until funds have been received and accepted by villa owner(s) or management company. If funds are not received within 7 banking days the reservation shall be deemed to have been cancelled.

3.3 Balance Payment

Final payment of the remaining balance must be paid to the villas owners/management according to a specific schedule in agreement with the villa owner(s) or management company unless otherwise specified in the availability confirmation. Should payment be due to be paid on site upon arrival Travellers Cheques, credit card withdrawals or cash exchange transactions can easily be accomplished at any Currency Exchange Counter at Bangkok Airport when you arrive (they have the most favorable exchange rates) or locally. Failure to make the final payment on this basis will make reservation subject to automatic cancellation.

If the booking is made within 30 days of the arrival date, 100% of the cost of the Villa rental shall be due at the time of booking, unless otherwise specified.

4. Cancellation of reservation

The cancellation charges applicable are in respect of each villas owners/management policy and are detailed in each villa rates and sales conditions. Please read them to fully understand the extent of the cancellation conditions prior to confirmation a reservation with the payment of a deposit.

The above cancellation charges also apply if the villa owner(s) or management company cancel the booking due to non-payment of the balance.

5. Change of booking

A US$50 administration fee may be charged by ethailandvillas.com or any of its affilitated sites for any change of booking after a confirmation has been issued. Acceptance of any change is subject to approval by the villa's owner(s) or management company.

6. Arrival & departure times

Guests should assume the Check-in time is after 3:00pm, and checkout time is prior to 12 noon, unless otherwise agreed by the Villa owner(s) or management company.

If applicable, the Guests are responsible to inform of your flight arrival/departure times in order to arrange the airport transfer.

7. Alteration and cancellation by thailand-villas.com

Though it is unlikely that ethailandvillas.com or any of its affiliated sites or the villas owners/management will have to make any changes to confirmed arrangements, it does occasionally happen, and we will advise you at the earliest possible date.

If the properties are damaged or rendered unusable or for any reason beyond our control or due to unexpected circumstances we are unable to provide you with the Villa booked, ethailandvillas.com or any of its affiliated sites or the villas owners/management shall reserve the right to cancel the reservation.

However, should guests agree, ethailandvillas.com or any of its affiliated sites or the villas owners/management will endeavor to locate an alternative property for the period required. If this is not possible, or you do not wish to be transferred, ethailandvillas.com or any of its affiliated sites or the villas owners/management will cancel the booking and refund you in full, less any processing fees charged by our bank.

ethailandvillas.com or any of its affiliated sites shall not be liable for any further obligations or claims by the client.

8. Registered guests

8.1 Registered guests

The number of people staying at the property must not exceed the maximum capacity indicated by you in the ethailandvillas.com or any of its affiliated sites booking form, except in the case of infants (under two years old), or unless specifically agreed with the villa owner(s) or management company. Should the owner or a management company representative find that the number of people staying at the property exceeds that on the booking form, additional guests will be subject to a per person, per day surcharge or may be asked to vacate.

8.2 Security

In respect of the villas owners and primarily for security reasons, it is absolutely prohibited for the guests to bring a male or female prostitute within the compound of the property (villa or apartment).

No camping is permitted in the property grounds and usually no pets are allowed on none of the properties, unless specified in the villa description sheet.

9. Security deposit

A security deposit may be payable to the villas owners or management company with the payment of the balance. This is to cover the cost of any damage or breakages during the rental period of the Villa or their contents. It may also be used to cover the cost of telephone calls and other services. This amount will be returned to you at the time of departure, less any such costs.

10. Insurance

It is a condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including local treatment, evacuation and repatriation coverage). As deposits and rental payments may not be refundable after a reservation has been confirmed, you should consider an option of this travel insurance to cover the loss of money paid to the villa in case of cancellation of your journey.

ethailandvillas.com or any of its affiliated sites or the villas owners or management company are not responsible and are held harmless by you and your party against any and all claims including any accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, jeep or motorbike rental.

ethailandvillas.com or any of its affiliated sites or the villas owners or management company shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside ethailandvillas.com or any of its affiliated sites or the villas owner(s) or management company 's control such as civil disturbances, fires, floods, severe weather, acts of God, acts of Government etc.

By acceptance of this contract it is assumed by ethailandvillas.com or any of its affiliated sites or the villas owner(s) or management company that this requirement has and will be complied with in full.

11. Liability release

ethailandvillas.com or any of its affiliated sites acts only as agent for the villa owners, suppliers and/or contractors who are providing accommodation, transport, and services.

Under no circumstances shall t ethailandvillas.com or any of its affiliated sites be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, however caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodation as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodation herein or as substituted.

If any accommodation and/or services are substituted, ethailandvillas.com or any of its affiliated sites will act at all times in good faith and use its best efforts to substitute with accommodations and/or services of a type comparable to or better than those originally contracted. ethailandvillas.com or any of its affiliated sites, at its sole and unfettered discretion, reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or guest services.

12. Complaints

All Villas have been selected as being to the different overall standard in terms of services, management and minimum required amenities and facilities and their maintenance as well as their quality and finish..

Each property description provided by ethailandvillas.com or any of its affiliated sites are made in good faith and provide the accurate information without any alterations, as provided by the villas owner(s) or the management company. We highly recommend you to read them carefully and enquire for further details should guests find it necessary.

ethailandvillas.com or any of its affiliated sites accepts no responsibility for the following:

• any modifications made by the villas owner(s) or management company that are not mentioned on the webpage or anywhere else
• the breakdown of the supply of water, or electricity, or swimming pool filtration systems

However, shall you contact us during such problem, we will use our best endeavours to arrange for any such problems to be solved quickly. Any complaints must be notified to the reservation contact point within 24 hours of the occurrence giving rise to the complaint.

Should a problem remain unsolved please make a complaint in writing to ethailandvillas.com or any of its affiliated sites or the villas owner(s) or management company within 14 days of the completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement this may result in the loss of all rights to compensation.

No claim can be done after the villa has been vacated without having made a notification at the time of the problem occurrence to the villas owner(s) or the management company.

No picture nor video are applicable for claim if neither a representative of the villas owner(s) or the management company are present at the time the pictures or the video are taken.

13. Conduct & behaviour

The person paying the deposit amount for the villa rental is responsible for the correct and appropriate behaviour of the guests staying at the Villa(s). Should any member of the party not behave in such a manner, the villas owner(s) or the management company may at their absolute discretion ask the offending guest or guests to vacate the Villa forthwith.

In respect of the villas owner(s) or the management company and primarily for security reasons, it is absolutely prohibited for the guests to bring a male or female prostitute within the compound of the villa.

14. Staff at the villas

Some of the villas include the service of 1 or several staff. Additional services such as those of cooks and/or drivers can usually be sourced. Please give ample notice as soon as possible; especially at peak holiday seasons and we shall try to assist.

ethailand-villas.com or any of its affiliated sites can assume no liability the behavior, action and quality of service provided by live in staff or other contracted staff. The rates for these services will be provided in advance and shall be paid by you as incurred.

15. Valuables

All villas are either equipped with a safe in one of the room or a safe is available at the villas owner(s) or the management company office.

Any valuables left at the property are at one's own risk. Nor the villas owner(s) or the management company nor their staff is responsible for their loss or damage.

16. Due care of the facilities

As part of this agreement and as all villas are privately owned, Guests are required to take due care when residing at the villas and especially children playing in the gardens, near or in the entrance, the road, the plunge pool/swimming pool, the beach including the sea.

Handling of furniture, crockery and other artifact shall be done with the maximum care. The villas staff, when provided as a service, is there to help if necessary.

Guests are reminded not to enter the Villas wet or to run around the swimming pool/plunge pool as the floors can be slippery. Damage or injury arising shall not be the responsibility of thailand-villas.com or the villas owners/management in any way whatsoever.

17. Applicable law

These conditions and any contract to which they apply are governed in all respects by Hong Kong law and the Hong Kong courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
